Terms and Conditions for Odyssey Math Tuition Online E-Learning Courses

These Terms and Conditions (“Terms”) govern your access to and use of the online e-learning courses (“Courses”) provided by Odyssey Math Tuition Pte. Ltd. (“we”, “us”, or “our”), a private limited company incorporated in Singapore with UEN 202514827H. By accessing, purchasing, or using our Courses through odysseymathtuition.com or any associated platforms (“Platform”), you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform or Courses. These Terms constitute a legally binding agreement between you (the “User” or “you”) and us. For the avoidance of doubt, the purchase of the Courses shall be deemed to constitute your understanding and acceptance of these Terms in their entirety.
- Acceptance of Terms
These Terms shall remain in full force and effect until terminated by either party. You may terminate this agreement at any time by ceasing all use of the Platform and Courses. We reserve the right to amend these Terms at any time in our sole and absolute discretion. Your continued use of the Platform or Courses following any such amendment shall constitute your acceptance of the revised Terms. Amendments will be published on the Platform with the date of revision. You must be at least 18 years of age or have obtained the consent of a parent or legal guardian to use our services. If you are below the age of majority for entering into contracts under Singapore law, your use of the Platform shall be deemed to have been made with the consent of your parent or legal guardian.
- Description and Access to Online Courses
The Courses comprise digital educational materials, including but not limited to videos, notes, questions, quizzes, worksheets, and exam question banks, which are designed to align with Singapore’s Ministry of Education curriculum. Upon successful payment, you are granted a personal, limited, revocable, non-exclusive, and non-transferable licence to access and view the Course materials solely for your private, non-commercial educational purposes, strictly during the term of your paid subscription (for example, 1, 3, 6, or 12 months). Your account is intended for use by a single individual only; the sharing of login credentials or facilitation of access by multiple users is strictly prohibited. In the event that you share account access with any other person, we reserve the right to suspend or terminate your access without refund. We may monitor usage, including through IP address logging, to detect any violations and may suspend access accordingly. Access to the Courses requires compatible devices and internet connectivity; we provide no warranty as to compatibility or uninterrupted availability. You shall be solely responsible for your own internet connection, devices, and software. We shall not be liable for any issues arising from connectivity, browsers, or third-party software. Whilst we endeavour to maintain high levels of server and service availability, we do not guarantee 100% uptime. No refund or compensation shall be provided in the event of any server or service downtime affecting access to the Courses. We may, at our discretion, modify, withdraw, or substitute content; in the event of any material impact on your access, we may provide alternative content or a pro-rata credit.
- Subscriptions and Payments
To access the Courses, you must create an account with accurate information and remit payment for a subscription. Subscriptions may renew automatically unless cancelled at least 7 days prior to the renewal date. All fees are quoted and payable in Singapore Dollars (SGD), inclusive of Goods and Services Tax (GST) where applicable. You shall bear any currency conversion or banking charges. Payments are processed securely; payment details (such as credit card information) are managed directly by authorised payment gateways in compliance with applicable banking standards—we do not store or retain such details. In the event of payment failure or reversal, access may be suspended until the matter is resolved. Subscriptions shall remain in full force and effect notwithstanding any changes to these Terms.
- Refund Policy
All purchases are subject to a 7-day no-questions-asked money-back guarantee. No refund shall be granted after the expiry of this 7-day period. No refunds shall be available for changes of mind, scheduling conflicts, dissatisfaction with content or teaching style, or failure to utilise or complete the Course beyond the guarantee period. For the avoidance of doubt, there shall be strictly no refund for any unused portion of the subscription. Refunds shall not be provided for technical issues attributable to your end or for suspensions arising from breaches of these Terms.
- Intellectual Property
All Course materials (including videos, notes, and questions) are owned by us or our licensors and are protected under the laws of Singapore governing copyright. You shall not download, copy, record, screen-capture, redistribute, post publicly, use for AI training, sell, employ for commercial tutoring, or create derivative works from the materials without our prior written consent. Any such derivative use, including downloading, copying, data mining, or employing automated tools for extraction, is strictly prohibited. Any breach may result in the immediate termination of access without refund and may lead to legal proceedings. If you submit questions, comments, or other content (for example, in sessions or forums), you grant us a worldwide, royalty-free licence to host and display it for the purposes of delivering the Courses and facilitating community interaction. Sessions may be recorded for quality assurance and replay purposes; by participating, you consent to such recording and agree not to redistribute it.
- User Obligations and Conduct
You shall be responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You must notify us immediately of any security breaches. You agree not to: gain unauthorised access to the Platform; use deep-links, robots, spiders, or similar tools to scrape or monitor content; upload viruses, corrupted files, or harmful code; impersonate others or misrepresent affiliations; post offensive, defamatory, obscene, or unlawful content; infringe intellectual property rights; engage in harassment, abuse, or disruption; or violate any code of conduct or applicable laws. We maintain a zero-tolerance policy for inappropriate conduct, academic dishonesty (such as sharing solutions), or misuse. We may suspend or terminate access without refund for any breaches. You shall indemnify and hold us harmless from and against all claims, damages, losses, and costs (including legal fees on a full indemnity basis) arising from or in connection with your breach or misuse of the services. You warrant that all information provided is accurate and complete.
- Disclaimers
The Courses are provided “as is” without any warranty of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of title, non-infringement, merchantability, or fitness for a particular purpose. We do not guarantee specific learning outcomes, grades, or qualifications. The content may contain errors; whilst you may report these for our review, we provide no warranty as to absolute accuracy or compatibility. We disclaim all liability for user-generated content, third-party links, or any offensive material encountered on the Platform. To the maximum extent permitted by law, we shall not be liable for any loss or damage to your devices, data loss, or performance issues arising from or in connection with your use of the Courses or Platform.
- Limitation of Liability
Nothing in these Terms shall limit or exclude our liability for death, personal injury, fraud, or any other liability that cannot be excluded or limited under Singapore law. To the fullest extent permitted by law: Our aggregate liability for all claims arising under or in connection with these Terms shall be limited to the fees paid by you in the 12 months immediately preceding the claim. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, data, profits, income, business, savings, or goodwill, whether foreseeable or not, and whether arising under contract, tort (including negligence), or otherwise. We shall not be liable for third-party products or services, advertisements, or errors or omissions in information provided. These limitations shall apply even if we have been advised of the possibility of such damages. Force majeure events (including but not limited to acts of God, natural disasters, cyberattacks, government restrictions, or internet failures) shall excuse performance without liability on our part.
- Termination
We may refuse, cancel, suspend, or terminate any order or access at our discretion for breaches (including but not limited to non-payment, misuse, or misconduct) without refund or liability. In the event that no contract is formed, payments shall be refunded. Termination shall not relieve you of any obligations to pay for services ordered or affect any accrued liabilities. Our rights to user-submitted content and your indemnification obligations shall survive termination.
- Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be resolved through arbitration in Singapore in accordance with the rules of the Singapore International Arbitration Centre (SIAC), conducted by a single arbitrator, or through mediation (such as via the Consumers Association of Singapore) prior to referral to the courts of Singapore. You agree not to engage in any conduct that threatens Singapore’s unity, integrity, defence, security, sovereignty, friendly relations with foreign states, or public order, or that incites offences, in accordance with applicable laws.
